Examples of recent work

  • Advising landowners in relation to travellers trespassing on farm land, issuing urgent possession proceedings and representing clients at County Court hearings to obtain immediate possession orders, followed by arranging urgent enforcement action to recover possession of the land.
  • Acting for landlords of residential premises (landed estates, charities, individuals) in relation to assured shorthold tenants in terms of compliance with the various regulations applicable to such tenancies and County Court possession proceedings. Also advising landlords in relation to other types of residential lettings, including ‘sitting tenants’ and licences.
  • Acting for both freehold owners of blocks of residential flats and, separately, flat owners in relation to applications to ‘extend’ the long leases in accordance with the Leasehold Reform, Housing & Urban Development Act 1993 (the process whereby flat owners seek to preserve the value of their flat); serving the relevant notices, instructing valuers, and negotiating premiums payable for the ‘extended’ leases. Representing clients in the First Tier Property Tribunal where the premium or other terms of the new lease cannot be agreed between the parties within the tight timescales provided by the relevant legislation. 
  • Advising commercial landlords and tenants in relation to forfeiture of leases, dilapidations, lease renewals, service charge and other disputes.
  • Advising a charity in relation to a statutorily protected agricultural tenancy granted by them some time ago – including advice regarding the applicable statutory regime and how to regain possession.
  • Acting for private individual seeking first registration at the Land Registry of commercial land on the basis of adverse possession.  An objection to the application was lodged resulting in a referral to First Tier Property Tribunal to determine the dispute, at which we are representing our client.
  • Acting for private individuals in relation to an application to the Upper Tribunal Lands Chamber for the modification of a restrictive covenant preventing residential development of their land following grant of planning permission.
  • Acting for an Almshouse charity in relation to residential occupant no longer entitled to occupy the Almshouse in question. Advising regarding notice procedure, issuing County Court possession proceedings and obtaining possession order.
