Patrick Brennan is an associate solicitor in our leading Wills, Probate, Tax & Trusts team.

Patrick specialises in the preparation of wills, estate and inheritance tax planning, probate and estate administration of taxable and non-taxable estates and drafting lasting powers of attorney (LPAs).

He regularly deals with administration of estates, both where the firm is acting as executor and on behalf of relatives, and with drafting wills designed to assist with tax planning and asset sheltering. Patrick also deals with the administration of various types of trusts, as well as assisting vulnerable people with their day-to-day affairs for whom the firm acts as independent deputies.

He is a member of the Private Client Section of the Law Society, a member of the Society of Trust and Estate Practitioners (STEP) and a full member of Solicitors for the Elderly, an independent, national organisation of lawyers (solicitors, barristers and legal executives) who provide specialist legal advice for older and vulnerable people, their families and carers. 

Examples of recent work

  • Advising on the structure of tax efficient wills in a variety of circumstances, including advising on the impact of the residence nil rate band.
  • Advising in relation to Capital Gains Tax (CGT), both for individuals and executors, during the administration period and the possibilities for mitigating this.
  • Working with foreign lawyers in relation to cross-border estates, including Spain, Cyprus, Australia and the USA, and tax planning for UK-domiciled clients with foreign assets, and foreign-domiciled clients with UK assets.
  • Advising on estates where there has been a dispute between either the executors themselves, or between the executors and beneficiaries – often acting as a mediator to try and avoid costly disputes.Advising clients in relation to setting up, ongoing administration and winding up of nil rate band discretionary trusts and the associated compliance points and tax implications.
  • Obtaining a Grant ad Colligenda Bona following an order made under s116 of the Administration of Estates Act 1925 in circumstances where the deceased’s family could not be located and his property was falling into a state of disrepair.
  • Advising beneficiaries as to their rights under a life tenancy set up under a will, both before the first death, between deaths and after the death of the life tenant.
  • Advising in relation to an estate facing multiple claims from the deceased’s family, who were challenging the will both on the basis of undue influence and the provisions of the Inheritance (Provision for Family & Dependants) Act 1975. Working in conjunction with colleagues in our Dispute Resolution team.
