Victoria Charlesson is an associate solicitor in our nationally ranked Planning & Environmental law team.

Her experience includes planning appeals and public inquiries, applications for certificates of lawfulness and development, advising on town and village greens, planning enforcement appeals/prosecutions and section 106 agreements. Victoria also has experience of highway law and environmental law including complex Section 278/38 Agreements, Compulsory Purchase Order and Environment Agency prosecutions including waste prosecutions.

Victoria works alongside partners Karen Jones and Simon Dimmick on a variety of strategic planning projects, spanning the Thames Valley and beyond, offering commercially pragmatic solutions to technically complex legal problems.

Planning magazine’s 2019 Planning Law Survey ranked Blandy & Blandy LLP among the UK's top 25 planning law firms, while the firm is also highly ranked in the UK's leading guides to law firms, Chambers UK and The Legal 500.

She attends and speaks at a wide range of planning and sector focused events in London and across the Thames Valley and is a regular speaker at the firm's annual Property & Planning law seminar.

Examples of recent work

  • Successful appeal against refusal of Local Planning Authority to allow removal of a tree protected by way of a Tree Preservation Order. The tree impacted on a listed structure under the Planning (Listed Buildings and Conservation Areas) Act 1990.
  • Review of applicability of Crichel Down rules and the potential compulsory purchase of a site to locate 3,000 new dwellings.
  • Section 278/38 Highway Agreements including the negotiation and preparation of a Section 278 Agreement required to enable the delivery of a new waste plant (circa £150 million) which was estimated to process around 190 million tonnes of waste per year.
  • Third party judicial review challenge: advice provided on whether an Environmental Impact Assessment was required due to the potential impact on EU protected sites, including special protection areas, ramsar sites and special areas of conservation.
  • Defence against prosecution for breach of extant enforcement notice and application for a confiscation order under The Proceeds of Crime Act 2002.
  • Section 106 Agreements and Community Infrastructure Levy (CIL) advice including the negotiation and preparation of Section 106 Agreements dealing with complex affordable housing requirements and delivery of strategic alternative natural greenspace (SANG).
