  • Advising on a successful simultaneous TUPE and Collective Redundancy consultation process on the closure of a factory and the transfer of work to another. The work involved negotiating complex indemnities covering the risk of claims by more than 100 employees and a potential liability in excess of £1m.
  • Advice on the transfer into a well-known sporting venue of a service provider’s employees under TUPE including analysis of the application of TUPE, assignment of employees, the mechanics of the process, pension implications including the auto enrolment implications of transfer and potential changes to roles post transfer/redundancy.
  • Pursuing Employment Tribunal Proceedings against the transferor in a TUPE transfer situation for failing to provide Employee Liability Information where the employees had made claims against both the transferor and our transferee client, securing a favourable settlement.   
  • Advising a supplier of services to the Public Sector on the expiry of its contract and its potential options including the promotion of the application of TUPE if it were not to re-tender and the provision of reduced service and the need to undertake collective redundancy consultation if it were to do so. A strategy was formulated for best protecting the client’s interests, ultimately secured with the agreement of a new contract covering the bulk of the services provided previously and a limited number of redundancies.
  • Advising a Charity on the TUPE implications of its proposal to take over the supply of a major service commissioned by a public sector client and reducing the negative impact of TUPE on the commercial viability of the project. Affected employees number approximately 100.
  • Advising senior executives of a major provider of IT solutions to the banking sector on claims arising out the termination of their employment including claims to bonuses, share options as well as notice, unfair dismissal and sex discrimination.
  • Advising a senior executive of a major food and drinks group seconded to the US from the UK on claims arising from the termination of their role including claims related to bonuses and share options as well as contractual and statutory claims. This involved formulating a strategy for maximising the settlement value in the context of claims in both US and UK jurisdictions and the potential application of two tax regimes.
  • Advising 3 senior executives of a major private healthcare group on the termination of their employment following a takeover, including the recovery at Tribunal of the maximum award  recoverable and a total payment in one case of approximately £200,000.

Partner Tim Clark is a specialist employment law solicitor. He trained as a litigator and then specialised in employment law, developing a particular expertise in dealing with re-organisation, restructuring, redundancy and TUPE issues.

He is very experienced in the strategic aspects of large scale workforce projects and presents on the subject on a regular basis, appearing on BBC television and radio as an expert commentator in the field. He regularly contributes to HR and personnel publications. Tim is recommended in both The Legal 500 and Chambers UK Guide for his expertise, with clients describing him as "proactive", with an ability to "rationalise and weigh up risks very objectively" and "explain the law clearly".

Tim also acts for senior executives advising on complex service agreements, commission and bonus arrangements, exit provisions and termination packages. He is an expert in the tax aspects of these arrangements.

Away from work, Tim enjoys gardening and has a keen interest in cars and motor racing.
