The Court of Protection exists to deal with all issues relating to those who unfortunately lack mental capacity to make decisions themselves. Our specialist Court of Protection solicitors can assist you if somebody close to you requires the help of the Court of Protection; for example, a mental health issue, learning disability, brain injury or illness.

Our Expertise

Based in Reading and Henley-on-Thames, we are one of the most experienced firms of solicitors advising on Court of Protection matters in the Thames Valley. Although based in Berkshire, we have been appointed by clients living in other counties, including Oxfordshire, Buckinghamshire, Hampshire, Surrey and Sussex.

Part of the role of the Court of Protection is to help protect and manage the property and financial affairs of people with mental incapacity to prevent them from being exploited or denied what is rightfully theirs. This can include situations where there are no family or friends to take on such a responsibility and cases where there may be a family dispute, a financial issue or where Social Services are involved. It can also include complex cases that relatives are not willing or able to deal with.

We understand that all Court of Protection cases are unique and can advise on all aspects, ranging from applying to have a deputy appointed to putting in place necessary care arrangements. Different court powers will apply depending on how substantial the individual’s assets are when they become incapable.
