Different court powers will apply depending on how substantial the individual’s assets are when they become incapable.

What is the Court of Protection?

The Court of Protection, based in London, exists to deal with all issues relating to those who unfortunately lack mental capacity to make decisions themselves. Our specialist Court of Protection solicitors can assist you if somebody close to you requires the help of the Court of Protection; for example, a mental health issue, learning disability, brain injury or illness.

Part of the role of the Court of Protection is to help protect and manage the property and financial affairs of people with mental incapacity to prevent them from being exploited or denied what is rightfully theirs. This can include situations where there are no family or friends to take on such a responsibility and cases where there may be a family dispute, a financial issue or where Social Services are involved. It can also include complex cases that relatives are not willing or able to deal with.

Court of Protection cases are normally heard by district judges and a senior judge, but in some cases may be heard by High Court judges. Cases can sometimes be transferred to a local court for a hearing.
